Terms of Service

These terms are the agreement between you and Consultant Finder. By creating an account or using the site, you agree to them. We have tried to write them in plain language — they are still a contract, so please read them.

What Consultant Finder is — and is not

Consultant Finder is a marketplace and matching platform for ERP contract consulting. Consultants create profiles and search for contract roles; companies post roles, browse consultants who have opted in, and manage applicants. Our job is to help the two sides find each other.

That means, clearly:

  • We are not a party to any agreement you reach through the platform. If a consultant and a company agree to work together, that contract is between them. We are not a signatory, a guarantor, or an intermediary to it.
  • We are not your employer, and we are not an employment agency, staffing agency, or recruiter. We do not hire anyone, do not place anyone, do not pay anyone for work performed, and take no commission on engagements.
  • We do not vet, endorse, or guarantee anyone.We do not verify a consultant's skills, experience, credentials, or right to work, and we do not verify that a company is legitimate, solvent, or actually hiring. Do your own due diligence before entering into any engagement, sharing sensitive material, or sending money.
  • We do not guarantee outcomes. No job, no hire, no interview, no response. Match percentages shown in the product reflect overlap between a profile and a listing — they are not a prediction of whether you will be hired.
  • We never apply on your behalf and never email anyone as you. Applications to on-platform roles are submitted by you. For listings sourced from elsewhere, you apply at the source yourself.

Your account

  • You must be at least 16 years old and legally able to enter into a contract to use Consultant Finder.
  • The information you provide must be accurate. This applies to both sides of the marketplace.
    • If you are a consultant: your profile, experience, skills, rates, and availability must be truthful and about you. Do not create a profile for someone else, and do not misrepresent who you are or who you have worked for.
    • If you are hiring: your company name and details, your job postings, and your hiring criteria must be truthful and about an organisation you are actually authorised to represent. Rates, contract length, location, and work type must reflect the role you are genuinely offering. Do not post a role you are not really hiring for, and do not post on behalf of a company without its permission.
  • Keep it up to date, whichever side you are on. An out-of-date rate, availability, or job posting that has already been filled wastes the time of everyone on the other side of the marketplace.
  • Your account is yours alone. Do not share your login, and keep your password and two-factor codes secret. You are responsible for what happens under your account. Tell us at info@flowkm.com if you think someone else has access to it.
  • One person or organisation, one account. Do not create accounts to evade a suspension or to inflate a presence on the platform.

Acceptable use

While using Consultant Finder, you agree not to:

  • Scrape, crawl, harvest, or bulk-export data from the site, whether by automated tools or by hand. Consultant profiles, contact details, and listings are here so that people can find each other one at a time — not to be collected into a database, a mailing list, or a product of your own.
  • Post fake or misleading listings or profiles — including roles that do not exist, roles posted only to collect resumes, or profiles for people who have not agreed to be listed.
  • Harass, abuse, threaten, discriminate against, or spam anyone you encounter here. Contact details on a profile are for discussing genuine consulting work, not for marketing, recruiting into unrelated products, or repeated unwanted outreach.
  • Use anyone's information for a purpose other than the one it was shared for. Using a consultant's email from the directory to add them to a mailing list is a breach of these terms.
  • Attempt to access accounts, data, or parts of the system that are not yours, probe or test our security without written permission, or interfere with the service's normal operation.
  • Upload malware, or upload content you do not have the right to share — including confidential material belonging to a current or former client or employer.
  • Break any applicable law, or use the platform to help someone else do so.

Your content and what we may do with it

  • You own your content.Whatever you submit stays yours, and we claim no ownership of it. For consultants that means your resume, profile, bio, and skills. For companies that means your firm's details, job postings, hiring posts, and the descriptions and criteria in them.
  • You give us a licence to run the service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, back up, reproduce, and display it for the purpose of operating Consultant Finder. In practice that means:
    • Consultant content — showing your profile to signed-in users of the platform (in practice, companies looking to hire), showing your application to the company you applied to, and showing your profile to a firm whose roster invitation you have accepted.
    • Hiring-side content — showing your job postings, hiring posts, and company name to consultants and other signed-in users searching the platform, and including them in search results and match results.
    That is the whole of it: we do not licence your content to third parties, sell it, or use it for advertising.
  • The licence ends when the content does.Remove content, switch off “open to work”, or delete your account, and we stop displaying it, subject to the retention described in the Privacy Policy.
  • You confirm you have the right to post what you post, and that it does not infringe anyone's rights or breach an obligation you owe someone else — a confidentiality agreement with a client or employer, for instance, or a restriction on publishing a company's name or the details of a role.
  • The site itself — its design, code, text, and branding — belongs to us. These terms do not give you a licence to copy or reuse it.

Job listings from third-party sources

A large share of the roles shown on Consultant Finder are aggregated from third-party job data providers. Those listings, and the rights in them, belong to their respective owners and sources. We display them for your convenience and link back to the source.

  • We do not guarantee that any listing is accurate, current, or genuine. A role may already be filled, may have been withdrawn, may have terms different from what the listing states, or may have been posted incorrectly at the source.
  • Some source websites restrict access by region, so a link may not open for you even though the role is real and open. Where we can, we show you the hiring company's name so you can find the original posting directly.
  • We show when a listing was posted and when we last confirmed it still existed at the source. Treat both as best-effort information, not a warranty.
  • Once you follow a link away from Consultant Finder, you are on someone else's site, subject to their terms and their privacy practices, not ours.

Fees

Consultant Finder is currently free to use. If we introduce paid features, we will say so clearly before you are charged anything, and you will never be billed without agreeing to it first.

Ending your account, and ours

  • You can leave at any time. Email info@flowkm.com from the address on your account to have it and your data deleted.
  • We can suspend or close an account that breaches these terms — particularly the acceptable-use rules — or where we reasonably believe it is being used to harm other users or the service. Where it is practical and appropriate, we will tell you why and give you a chance to respond first. For serious cases such as scraping, fraud, or harassment, we may act immediately.
  • We may also discontinue the service, or any part of it. If we shut Consultant Finder down, we will give account holders reasonable notice by email so you can retrieve anything you need.
  • Sections that by their nature should survive the end of your account — licences for material we have already lawfully displayed, disclaimers, limitation of liability, and governing law — continue to apply afterwards.

No warranties

Consultant Finder is provided “as is” and “as available”. We work to keep it running and accurate, but we do not promise that it will be uninterrupted, error-free, secure against every possible attack, or that the information in it — especially listings from third-party sources, and profiles written by other users — is accurate, complete, or current.

To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow certain warranties to be excluded; where that is the case, this section applies to the extent permitted, and nothing here removes rights you have under consumer protection law that cannot be waived.

Limitation of liability

In plain terms: this is a free service run by one person, and there is a limit to what we can be held responsible for.

  • We are not liable for anything that happens between you and another user — a contract that goes wrong, work that is not paid for, a role that turns out not to exist, a consultant who does not perform, or a dispute of any kind. Those are matters between the parties involved.
  • To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, lost opportunities, or lost data, arising out of your use of the service.
  • Where liability cannot be excluded, our total liability to you for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim (currently zero, since the service is free) or CAD $100.
  • Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

Your responsibility for your own conduct

In plain terms: if what you do here costs us money, that is on you, not on us.

If someone brings a claim, demand, or investigation against us because of something you did, you agree to defend us against it and to cover the losses, damages, settlements, and reasonable legal costs we incur as a result. This covers, in particular:

  • content you posted — a profile, resume, job posting, hiring post, or message;
  • your breach of these terms, especially the acceptable-use rules on scraping, fake listings and profiles, and harassment;
  • your infringement of someone else's rights, including intellectual property, privacy, and confidentiality obligations you owe a client or employer;
  • your breach of any law that applies to you;
  • any dispute between you and another user, including anything arising out of an engagement you agreed to through the platform.

We will tell you promptly about any claim covered by this section, and you will not settle it in a way that puts an obligation or an admission on us without our agreement. Nothing in this section makes you responsible for something we did wrong ourselves.

Changes to these terms

We may update these terms as the service changes. When we do, we will update the “last updated” date at the top of this page. Where a change materially affects your rights or obligations, we will take reasonable steps to tell account holders before it takes effect — for example by notice on the site or by email — but this page is the authoritative current version, so it is worth checking. Continuing to use Consultant Finder after a change takes effect means you accept the updated terms; if you do not, close your account.

Governing law

These terms are governed by the laws of Alberta, Canada, and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. Any dispute arising out of these terms or your use of the service will be brought in the courts of Alberta, Canada, and you agree to their jurisdiction. If you are a consumer in a country whose law gives you the right to bring a claim locally, this does not take that right away.

The rest

  • These terms, together with the Privacy Policy, are the entire agreement between you and us about the service.
  • If any part of these terms is found unenforceable, the rest stays in force, and the unenforceable part is applied as closely as the law allows to what it intended.
  • If we do not enforce a term straight away, that is not a waiver of our right to enforce it later.
  • You may not transfer your rights under these terms to anyone else. We may transfer ours if the service changes hands, in which case we will tell you.
